These App Terms and Conditions (“App Terms”) apply to your download, access, and use of the Arkhival mobile application (the “App”), including any updates or related services. These App Terms are intended to comply with the requirements of the Apple App Store and Google Play Store, as well as Australian law.

By downloading or using the App, you agree to be bound by these App Terms. If you do not agree, do not download or use the App.


1. About Arkhival

Arkhival (“we”, “us”, “our”) provides a digital platform designed to help individuals and families preserve, organise, and share memories, stories, photographs, videos, audio, and other personal content across generations.


2. Eligibility

You must be at least 18 years old to create an Arkhival account.

If you are under 18, a parent or legal guardian must create and manage your access to the App.

By using the App, you confirm that you have the legal capacity to enter into a binding agreement.


3. Account Registration

To use most features of the App, you must create an account.

You agree to: – Provide accurate, current, and complete information – Keep your login details secure – Notify us immediately of any unauthorised use of your account

You are responsible for all activity that occurs under your account.


4. Subscriptions and In-App Purchases

4.1 Paid Features

Arkhival offers both free and paid subscription plans. Paid subscriptions may be offered as auto-renewing in-app purchases.

Subscription details, pricing, billing periods, and features will be displayed in the App at the time of purchase.

4.2 Billing

  • Payment will be charged to your Apple ID or Google Play account upon confirmation of purchase
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • Renewal charges will occur within 24 hours prior to the end of the current period

4.3 Managing Subscriptions

You can manage or cancel your subscription through your Apple App Store or Google Play account settings. We cannot manage subscriptions on your behalf.

4.4 Price Changes

If subscription pricing changes, we will notify you where required by law or platform rules.


5. User Content

5.1 Ownership

You retain ownership of all content you upload or create using the App, including photos, videos, audio recordings, text, and other materials (“User Content”).

5.2 Licence to Arkhival

By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, back up, reproduce, and display your content solely for the purpose of operating, maintaining, and improving the App.

This licence ends when you delete your content or account, except where retention is required by law or for backup, security, and integrity purposes.

5.3 Responsibility for Content

You are responsible for ensuring that: – You have the right and permission to upload the content – You have obtained consent from individuals appearing in your content – Your content does not infringe the rights of others or breach any laws


6. Shared and Family Spaces

The App may allow you to invite others into shared or family spaces.

You acknowledge that: – Content shared in a group may be viewed by all invited members – You are responsible for whom you invite – We are not responsible for disputes between family members or other users


7. Acceptable Use

You must not use the App to: – Upload unlawful, harmful, abusive, or offensive content – Infringe intellectual property or privacy rights – Attempt to gain unauthorised access to systems or data – Interfere with the operation, security, or performance of the App

We may suspend or terminate access for misuse.


8. Privacy

Our collection and handling of personal information is governed by our Privacy Policy, which complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

By using the App, you consent to the collection, use, and disclosure of personal information as described in the Privacy Policy.


9. Data Storage and Backups

While we take reasonable steps to protect and back up User Content, you acknowledge that: – No system is completely secure – Data loss may occur – You are responsible for maintaining your own backups of important content

We do not guarantee permanent availability of any User Content.


10. Intellectual Property

All intellectual property rights in the App, excluding User Content, are owned by or licensed to Arkhival.

You must not copy, modify, distribute, reverse engineer, or exploit any part of the App without our prior written consent, except as permitted by law.


11. Third-Party Services

The App may integrate with third-party services (including cloud storage, payment providers, or platform services).

We are not responsible for: – Third-party services or content – Loss or damage caused by third-party platforms

Your use of third-party services is subject to their own terms.


12. Disclaimer

The App is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we do not warrant that: – The App will be uninterrupted or error-free – Content will always be available or preserved

Nothing in these App Terms excludes or limits consumer guarantees under the Australian Consumer Law.


13. Limitation of Liability

To the maximum extent permitted by law: – We are not liable for indirect or consequential loss – Our total liability is limited to resupplying the services or the amount you paid to us in the 12 months before the claim arose

This clause does not limit rights that cannot be excluded under the Australian Consumer Law.


14. Termination

14.1 By You

You may stop using the App or delete your account at any time.

14.2 By Us

We may suspend or terminate your access if: – You breach these App Terms – Required by law or platform rules – The App is discontinued

Where practicable, we will provide reasonable notice.


15. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, you acknowledge that: – These App Terms are between you and Arkhival, not Apple – Apple has no obligation to provide maintenance or support services – Apple is not responsible for any claims relating to the App – Apple is a third-party beneficiary of these App Terms and may enforce them against you


16. Google Play Additional Terms

If you downloaded the App from Google Play, you acknowledge that: – These App Terms are between you and Arkhival, not Google – Google has no responsibility or liability relating to the App


17. Changes to These App Terms

We may update these App Terms from time to time.

Updated terms will be made available in the App or via the App Store listing. Continued use of the App constitutes acceptance of the updated App Terms.


18. Governing Law

These App Terms are governed by the laws of New South Wales, Australia.

You submit to the exclusive jurisdiction of the courts of New South Wales.
